Qualified Domestic Relations Orders

When dividing retirement benefits it is important to remember that no one has yet paid any taxes on these assets and only benefits that accrued during marriage are subject to division as community property.  There are special Federal statutes which allow for the division of retirement benefits without disturbing the pre tax nature of these assets.  These special pension division orders are known as QDRO’s – Qualified Domestic Relations Orders.  Mr. Ziff has been drafting and implementing QDRO’s for over 25 years and can help you understand when a division is clean and simple and when it might present special problems where his expertise can help you get a fair and beneficial resolution to your pension division problem.
